The next battle between Apple and Samsung in their global patent war will likely be waged in the Federal Circuit U.S. Court of Appeals.

Apple lost its bid late Friday to keep Samsung’s Galaxy smartphones and tablets out of the United States when San Jose federal Judge Lucy Koh denied its request for a preliminary injunction against sales of three Samsung smartphone models, as well as the Samsung Tab 10.1.
