In the latest chapter of the hotly disputed and highly political litigation over New York City’s “Stop-and-Frisk” policy, the U.S. Second Circuit Court of Appeals has rejected Judge Shira Scheindlin’s attorney’s motions. Her attorney, Burt Neuborne, is a professor at New York University School of Law’s Brennan Center for Justice.
The court denied four motions, two by the City of New York attempting to vacate certain orders in the case. The other two motions were the primary focus of the court’s order, rejecting assertions by Neuborne that the Second Circuit was unaware of certain proceedings, and that the appellate court relied on press reports in making its decision to remove Scheindlin from the cases.
