Complex and expensive — that is how Natasha Williams, Sanofi’s director of global litigation and investigation, described the challenges of international attorney-client privilege at the “Perspectives on Global Privilege” panel at the Electronic Discovery Institute’s recent Leadership Summit in Santa Monica.

The biggest culprit: email. Kimberly Newman, Walmart’s associate general counsel, said in-house counsel privilege protections vary from country to country. Many countries, such as France, offer little to no protection to counsel for internal corporate communications.
