>> Cyberliability: In the wake of recent large-scale, widely-publicized data breaches; class action lawsuits; state attorneys general investigations and federal government investigations, we will see increased awareness of the legal, financial and reputational risks associated with data breaches. Companies will begin to realize that they need adequate data protection processes and strategies in place to prevent real (or perceived) failure.

Companies will become increasingly concerned about securing consumers’ personal information and protecting systems that contain confidential, proprietary and commercially sensitive information so the data is not vulnerable to hackers and data breaches. Expect companies to require law firms, consultants, cloud providers and other third parties to demonstrate that they are knowledgeable about cyber-security and have taken appropriate steps to protect sensitive data. The risks—notifying consumers and government agencies, and defending lawsuits—will lead to increased interest in cyber-insurance coverage. — Gail Gottehrer, partner, Axinn, Veltrop & Harkrider, New York.
