Mishandling a data breach could be detrimental, to put it mildly, so a panel at ALM’s Cybersecurity and Data Protection Legal Summit discussed best practices for effectively handling data breaches. About 70 people attended the hour-long morning session, “First Responders: How Outside Counsel and Forensic Investigators Help Clients Respond to a Data Breach,” held at The Harvard Club in New York City. Panelists: Two partners at Ropes & Gray: Richard Batchelder and Mark Szpak, and Erin Nealy Cox, executive managing director at consultancy Stroz Friedberg.

There have been 4,449 publicly announced data security breaches since 2005, the panelists said, citing data from the Privacy Rights Clearinghouse’s Chronology of Data Breaches. The Ponemon Institute said the cost of stolen personal information per record is $201 and averages $5.9 million per incident, the panel noted.
