Docket Alarm Inc. is sounding off about its new Patent Trial and Appeal Board predictive tool. Using criteria such as a judge’s name, area of technology, and keywords, the system can search through the 2,482 PTAB proceedings and 160,240 PTAB documents in its system and outputs win rates, average length of proceedings, and estimates the likelihood of settlements.

Win rates can be viewed by judge or by Patent & Trademark Office technology center. The PTO has numerous centers that handle patent categories, such as biotechnology and organic chemistry, chemical and materials engineering, designs, transportation, etc. The data includes:

  • Whether a judge is more or less likely to institute petitions in full or in part, and the margin of error.
  • If there are too few cases to form a confident statistic.
  • The number of petition grants and denials analyzed to come up with the results.
  • The percentage of petitions instituted in full or in part since PTAB inception.
  • The percentage of petitions instituted in full or in part during the last three months.
