A new decision by the Seventh Circuit Court of Appeals involving a large data breach at Neiman Marcus appears to allow a class-action lawsuit to proceed.
The ruling is considered important given the number of data breaches among retailers. Also, it addresses the argument that the customers impacted by the data breach are likely to be injured despite that they did not yet experience identity theft or other kinds of fraud.
