Even though some current cases before the Supreme Court could make it more difficult to bring a class action, there are continuing concerns about class action lawsuits stemming from cybersecurity incidents.

These include the release of confidential information belonging to employees, consumers or others – or the financial impact of a breach leading to litigation by shareholders. Moreover, it is possible that data only needs to be compromised for a suit to be filed, without any actual damage having been done.
