There has been a flurry of recent activity regarding public records and the U.S. Environmental Protection Agency (EPA) as the Trump administration plans its environmental policy , particularly when it comes to how the EPA and its employees and partners are using data. One issue relates to EPA employees’ use of an encrypted messaging app, and another relates to the outside archiving of EPA data by scientists.

The Signal and the Noise

Regarding employees, the Cause of Action Institute recently sued the EPA in the U.S. District Court for the District of Columbia in an effort to get government records released after it was revealed some agency employees had used an encrypted messaging application, known as “Signal.” The EPA recently stated there is an “open law enforcement” investigation related to the issue.
