General counsel who want their companies to use less office space to store employee records and who want to streamline the employment verification process for new employees may want to take advantage of Public Law 108-390. It allows for the electronic completion and storage of I-9 forms, the required employment-eligibility verification forms for all employees, regardless of citizenship, under the Immigration Reform and Control Act.

The law amends 274A(b) of the Immigration and Nationality Act. On Oct. 30, 2004, President George W. Bush signed Public Law 108-390, and it took effect April 28, 2005. The U.S. Department of Homeland Security (DHS) administers the law and enforces employer compliance with regard to I-9s.
