Production of electronic data is regulated by the Federal Rules of Civil Procedure. Proposed amendments to the FRCP, set to go into effect Dec. 1, 2006, will affect various aspects of production of electronically stored information.
Proposed Rule 16(b) would allow for the court’s pre-trial scheduling order to include provisions concerning electronically stored information.
