In the October issue of Law Technology News, Michael Arkfield, Craig Ball and J. William Speros provided an illuminating discussion of who is responsible for the success of electronic data discovery. They raised important questions about the things that can go wrong and suggested that an attorney needs to evaluate a vendor’s capabilities to protect from liability. I’d like to offer some pragmatic advice to help attorneys implement their suggestions, identifying and mitigating the risks of EDD.
EDD consists of several steps. Each step has to be executed accurately and completely in order to produce the correct data in the end.
