Who doesn't love a good discovery fight? And this one involving Cravath, Swaine & Moore is a doozy, with ramifications that extend literally across the planet.
The firm is locked in a battle with an international human rights and environmental group for refusing to release a trove of documents from client Royal Dutch Petroleum Co. related to the execution of nine men in Nigeria in 1995.
The U.S. Court of Appeals for the Second Circuit will hear oral arguments on Tuesday in Kiobel v. Cravath Swaine & Moore, with Hogan Lovells appellate star Neal Katyal representing the firm.
