Our runners up for Litigator of the Week include Goodwin Procter's David Zimmer. He led a team in convincing a Boston federal judge to issue a preliminary injunction that prevents ICE from making civil arrests at Massachusetts state courthouses.
Zimmer and partner Daryl Wiesen, along with Oren Nimni of Lawyers for Civil Rights, represented Suffolk County District Attorney Rachael Rollins, Middlesex County District Attorney Marian Ryan and the Chelsea Collaborative. Plaintiff Committee for Public Counsel Services was represented in-house by Wendy S. Wayne.
Simpson Thacher & Bartlett partners Abram Ellis, Sara Razi and Peter Thomas won dismissal of claims against McKesson Corp. in an antitrust class action in the Eastern District of Pennsylvania. The company was alleged to be part of a broader conspiracy to allocate the market for and fix the prices of certain generic pharmaceutical products.
Baker Botts partners Gavin Villareal, Amy Hefley and Bill Kroger won dismissal of a lawsuit seeking to block Kinder Morgan's $2 billion pipeline. The Texas state court affirmed their argument that the eminent domain process was constitutional and included adequate safeguards for Texas landowners.
Lawyers from Quinn Emanuel Urquhart & Sullivan notched a trio of wins.
Isaac Nesser, Peter Calamari and William Price secured a $68 million final judgment for ResCap Liquidating Trust in Minnesota, where Judge Susan Richard Nelson also approved $23 million in legal fees for the firm. “This case required the top-notch legal counsel that ResCap retained,” she wrote. “[T]he experience, reputation, and ability of plaintiff's counsel was outstanding.”
QE's Marc Greenwald and Manisha Sheth represented Amplifi, a division of Japanese firm Dentsu. They prevailed over Marc Kasowitz and his client W50 in a contractual fight over financing a music festival marking the 50th anniversary of Woodstock.
And Mike Carlinsky scored for insurance brokerage Lockton in a brutal fight involving non-compete agreements. (See my story about the case, Daily Dicta: Quinn Team Bests Morgan Lewis in Delaware Fight over Worst (Non-Lawyer) Lateral Acquisition Ever ).

Edmund Polubinski and Marie Killmond of Davis Polk & Wardwell have entered appearances for data platform software development company MongoDB and other defendants in a pending shareholder derivative lawsuit. The action, filed Oct. 7 in New York Southern District Court by the Brown Law Firm, accuses the company's directors and/or officers of falsely expressing confidence in the company’s restructuring of its sales incentive plan and downplaying the severity of decreases in its upfront commitments. The case is 1:24-cv-07594, Roy v. Ittycheria et al.

Amy O. Bruchs and Kurt F. Ellison of Michael Best & Friedrich have entered appearances for Epic Systems Corp. in a pending employment discrimination lawsuit. The suit was filed Sept. 7 in Wisconsin Western District Court by Levine Eisberner LLC and Siri & Glimstad on behalf of a project manager who claims that he was wrongfully terminated after applying for a religious exemption to the defendant's COVID-19 vaccine mandate. The case, assigned to U.S. Magistrate Judge Anita Marie Boor, is 3:24-cv-00630, Secker, Nathan v. Epic Systems Corporation.

David X. Sullivan, Thomas J. Finn and Gregory A. Hall from McCarter & English have entered appearances for Sunrun Installation Services in a pending civil rights lawsuit. The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M. Berke on behalf of former employee George Edward Steins, who was arrested and charged with employing an unregistered home improvement salesperson. The complaint alleges that had Sunrun informed the Connecticut Department of Consumer Protection that the plaintiff's employment had ended in 2017 and that he no longer held Sunrun's home improvement contractor license, he would not have been hit with charges, which were dismissed in May 2024. The case, assigned to U.S. District Judge Jeffrey A. Meyer, is 3:24-cv-01423, Steins v. Sunrun, Inc. et al.
