Let's start with Mike Stenglein of King & Spalding, who landed Litigator of the Week honors last year after representing Colombia's Refinería de Cartagena, or Reficar, in a six-week remote arbitration against Chicago Bridge & Iron over cost overruns and construction delays. Last week U.S. Bankruptcy Judge Christopher Lopez in Houston signed off on orders routing nearly $900 million in payment to Reficar—including preferred shares that convert to 19.9% of the common equity of Chicago Bridge & Iron owner McDermott International Ltd. Stenglein led the team on the matter alongside restructuring partner Matt Warren, and disputes partners Tom Sprange and Sarah Walker. The arbitration team included Adam Gray, Harry Burnett, Doak Bishop, Roberto Aguirre Luzi, Matt Vandenberg, Luke Roniger, Jeff Mills, Nate Bilhartz and Luisa Gutierrez Quintero. Sandra Goldstein and her team at Kirkland & Ellis this week got the Second Circuit to uphold their trial win for Constellation Brands in a dispute over whether the company's Corona- and Modelo-branded hard seltzers violated its long-term licensing agreement with Grupo Modelo to produce "beer" in the U.S. under those trademarks. The Second Circuit agreed with the district court that the definition of "beer" in the agreement was ambiguous, upholding the lower court's summary judgment ruling, and found that the jury instructions regarding contract interpretation were proper. Goldstein argued the appeal at the Second Circuit. The Kirkland team also includes Stefan Atkinson, Sierra Elizabeth, Dan Cellucci, George Hicks and Bob Allen.

The suit, filed Dec. 11 in New York Southern District Court by Bleichmar Fonti & Auld, accuses the defendants of concealing the bank's 'pervasive' deficiencies in regards to its compliance with the Bank Secrecy Act and the quality of its anti-money laundering controls. The court action, filed Nov. 25 in Michigan Eastern District Court by Hooper Hathaway PC on behalf of The Town Residences LLC, accuses Crown Castle of failing to transfer approximately $30,000 in utility payments from T-Mobile in breach of a roof-top lease and assignment agreement.
