First up this week is a team at Covington & Burling that knocked out a $107.5 million patent infringement verdict facing pharmaceutical client AstraZeneca tied to Tagrisso, its drug used to treat certain types of non-small cell lung cancer. After a five-day trial in May, federal jurors in Delaware found that AstraZeneca induced infringement of two patents held by Wyeth. But U.S. District Judge Matthew Kennelly this week found the Wyeth patents invalid for lack of written description and granted AstraZeneca’s motion for judgment as a matter of law. A trial team led by John Quinn of Hecker Fink and Keith Corbett of Harris Beach secured a ruling keeping independent presidential candidate Robert F. Kennedy Jr. off the Nov. 5 ballot in New York. After a four-day bench trial earlier this month, State Supreme Court Justice Christina Ryba of Albany County this week found that Kennedy’s connections to a Westchester County address listed on his nominating petition “existed only on paper and were maintained for the sole purpose of maintaining his voter registration and political standing in the State of New York.” The trial team representing the petitioners—New York voters backed by Democrat-aligned political action committee Clear Choice—also included Howard Colton of Law Office of Howard Colton and Hecker Fink’s Kate Harris, Joe Posimato, Tayonna Ngutter and Ian Robertson.
