Judging by a ruling issued on Tuesday, defense lawyers have their work cut out for them in the latest False Claims Act lawsuit alleging that Novartis AG offered doctors kickbacks to prescribe certain drugs.

U.S. District Judge Paul Gardephe in Manhattan refused to dismiss claims by the U.S. government and New York state that Novartis bribed doctors through “sham” speaking gigs and lavish meals. Novartis’ lawyers at Cravath, Swaine & Moore and Kaye Scholer had argued there was no specific evidence of a kickback scheme that defrauded Medicare and other government programs, but Gardephe disagreed.
