SAN FRANCISCO — A Delaware federal judge has unsealed his Sept. 25 order granting NetApp’s attorney fees against Acacia Research subsidiary Summit Data Systems, and it’s a doozy.

U.S. District Judge Gregory Sleet awarded all $1.4 million in fees and costs sought by NetApp, plus “any additional expenses” incurred in bringing its fee motion, along the way excoriating Acacia and its subsidiary for bringing “reckless and wasteful litigation” and then negotiating nuisance value settlements.
