Former football players who opted out of a $50 million settlement for “publicity rights” have fumbled.

On Friday, U.S. District Judge Paul Magnuson in St. Paul held that the First Amendment protects the National Football League from claims brought by three former players who want the league to pay them for the unauthorized use of their images in the popular NFL Films. He granted the NFL summary judgment in a 40-page ruling that could affect the claims of roughly 2,000 other opt-out players with cases before him.
