Three months after a whistleblower’s case against a major Texas manufacturer of highway guardrail systems ended in a mistrial, platoons of lawyers for both sides are gearing up for closing arguments in a retrial now underway in federal court in Marshall, Texas.
Lawyers are expected to make their final case to the jury on Monday in the False Claims Act lawsuit, which accuses Dallas-based Trinity Industries Inc. of concealing a fatal design flaw in its guardrails from federal highway officials. The stakes for Trinity are immense. Under the FCA, any verdict would be trebled, potentially costing the company $1 billion in penalties.
