A federal jury in Marshall, Texas, on Monday ordered the manufacturer of a guardrail system found on most U.S. highways to pay the government $175 million for withholding critical information about design changes to an approved safety feature. The real cost to Dallas-based Trinity Industries Inc., however, may be much greater after the trebling of the verdict, statutory claims, prejudgment interest and attorney fees.

Whistleblower Joshua Harman alleged during last week’s trial that the company made a cost-cutting design change to a guardrail component after it was approved by the Federal Highway Authority. The modification allegedly caused some highway guardrails to spear through vehicles rather than collapsing as designed.
