Plaintiffs lawyers at Hagens Berman Sobal Shapiro failed this week to convince a Chicago federal judge to approve a proposed settlement that aimed to resolve concussion claims by college athletes nationwide. The firm had asked U.S. District Judge John Lee to give preliminary approval to a deal that would have created a $70 million medical monitoring program for 4.2 million student-athletes.

In a ruling on Wednesday, Lee said the proposed settlement with the National Collegiate Athletic Association was “a significant step in trying to arrive at a resolution of this highly complex matter.” But the judge questioned whether $70 million would be enough. He also pointed out numerous deficiencies in the deal, including that the program might not properly protect students who play sports like baseball and water polo, which are considered noncontact sports under the settlement.
