The U.S. Supreme Court will once again weigh the standards for class actions, agreeing on Monday to consider whether courts should certify a class in situations where the class may include members who don’t have any damages.

The justices granted certiorari in Tyson Foods v. Bouaphakeo, an employment case accusing Tyson of failing to pay workers at an Iowa meat-processing facility for time they spent putting on and taking off protective gear and walking to worksites. The appeal comes to the high court after the U.S. Court of Appeals for the Eighth Circuit affirmed a jury verdict and a $5.8 million judgment against Tyson.
