The National Association of Broadcasters and its lawyers at Gibson, Dunn & Crutcher have fallen short in their challenge to a Federal Communications Commission plan to repackage television airwaves for use by mobile Internet providers.

In a technical 33-page opinion, the U.S. Court of Appeals for the D.C. Circuit on Friday upheld the FCC proposal over petitions from the NAB and Sinclair Broadcast Group Inc. Gibson Dunn’s Miguel Estrada argued for the NAB, while Pillsbury Winthrop Shaw Pittman’s John Hane III argued for Sinclair, a company that owns television stations throughout the U.S. FCC associate general counsel Jacob Lewis represented the government.
