An African-American flight attendant for United Air Lines Inc. who received anonymous death threats on the job can proceed with her hostile work environment against the airlines, now that the U.S. Court of Appeals for the Fourth Circuit has vacated a lower court ruling.
In a unanimous opinion authored by Judge Roger Gregory, the Fourth Circuit held that the facts alleged by plaintiff Renee Pryor were very different from the kind of offhand comments or teasing that courts have typically found can’t support hostile work environment claims. Instead, wrote Gregory, “the conduct at issue in this case is some of the most serious imaginable in the workplace—an unmistakable threat of deadly violence against an individual based on her race.”
