With potential damages in the billions, pay-for-delay lawsuits against drugmakers are a tempting new target for plaintiffs lawyers.
Indeed, The National Law Journal reported this week that there has been an “explosion” in suits after the U.S. Supreme Court in 2013 ruled that such arrangements could run afoul of antitrust laws.
