Richard Pepperman II and Robert Wick faced an unusual challenge in a proposed class action accusing Goldman Sachs Group Inc. and JPMorgan Chase & Co. of conspiring to drive up zinc prices.

Just months before, U.S. District Judge Katherine Forrest in Manhattan had allowed antitrust claims to move forward against an overlapping group of defendants in a similar lawsuit related to another metal, aluminum. Now Sullivan & Cromwell’s Pepperman and Wick, a partner at Covington & Burling, were asking her to toss closely parallel allegations in the zinc litigation.
