In patent litigation, it’s almost de rigueur these days for a company accused of infringement to challenge the validity of the patents at issue before the new Patent Trial and Appeal Board at the U.S. Patent and Trademark Office.

But the board doesn’t agree to take up every petition. And if it does, it’s up to the individual district court judge whether or not to put parallel litigation on hold pending the patent office review.
