Andrew Bridges cited the minutiae of copyright law to defeat a serial plaintiff's claims against clients Giganews Inc. and Livewire Services Inc. and collect $5.6 million in attorneys' fees and costs.
“I like to joke that I have a secret weapon that I come into court with — the actual text of the Copyright Act,” said Bridges, a San Francisco partner at Fenwick & West.
In November 2014, U.S. District Judge André Birotte Jr. held that the defendants had not directly or indirectly infringed copyrights held by adult website Perfect 10 Inc. Birotte, of the Central District of California, also dismissed the plaintiffs' trademark, right of publicity and California Unfair Competition Law claims. In March 2015, Birotte slapped plaintiff Perfect 10 with that award for attorney fees and costs.
