Tell us about your biggest trial win from January 2017 to July 2018 and how you achieved the result for your client.

One of our biggest trial wins was a true team effort in a case involving the proposed merger of Xerox and FujiFilm. Representing Darwin Deason, Xerox's third-largest shareholder, we successfully enjoined the proposed merger following a two-day preliminary injunction hearing during which the New York Supreme Court heard testimony from 12 witnesses and received over 650 exhibits into evidence. The court found that Xerox's former CEO colluded with Fuji against Xerox's shareholders to design a transaction that would have given Fuji control over Xerox without costing Fuji a penny while preserving the jobs of the CEO and board members. The trial followed months of contentious pre-hearing briefing and discovery.

Share two trial tips that have been key to your success.
  1. Intense pretrial preparation and collaboration is critical. We worked closely with our graphics team to ensure our cross-examinations were clean and crisp and featured the key documentary evidence supporting our themes.
  2. Maintain a professional and polite demeanor during cross-examinations while being thorough, assertive and unrelenting—these are not mutually exclusive concepts.
