A big shoe just dropped at the U.S. Patent and Trademark Office.

The agency launched a formal review Monday of the PTO director’s discretion for instituting or denying America Invents Act (AIA) challenges to patent validity. When they’re completed, the rules will have a lot to say about which accused infringers can bring AIA challenges, known as IPRs.
