In GE Energy v. Outokumpu, the U.S. Court of Appeals for the Eleventh Circuit held that nonsignatories couldn't enforce international arbitration agreements because the New York Convention doesn't specifically mention nonsignatory enforcement. We convinced the U.S. Supreme Court to grant cert to undertake its first in-depth examination of the Convention. Reversing the Eleventh Circuit, the court held that the Convention sets a floor, not a ceiling, for enforcing international arbitration agreements. It doesn't foreclose enforcement by nonsignatories if domestic law would allow it. This result was a boon for international commerce.
