Last term, McDermott Will & Emery argued four cases in the U.S. Supreme Court. Two 2020 wins, Nasrallah v. Barr and Guerrero-Lasprilla v. Barr, vastly expand the scope of judicial review over immigration proceedings. In Nasrallah, we advanced a novel statutory construction argument, convincing the court to hold that factual findings underlying Convention Against Torture claims are reviewable. Although 10 circuits had previously addressed this question, not one had considered the theory that we advanced. In Guerrero-Lasprilla, we reframed the central issue, leading the court to hold that mixed questions of fact and law are reviewable.
