A judge on the U.S. Court of Appeals for the Sixth Circuit called out her colleague over his questioning of a media source she included in an opinion, noting other times where he has included non-judicial sources in his rulings, including a paraphrase of a Grateful Dead lyric.

In the opinion issued Monday, the panel affirmed a district court ruling denying compassionate release to a man incarcerated at the federal correctional facility at Terre Haute, Indiana. Judges Karen Nelson Moore, John Rogers and Chad Readler of the Sixth Circuit ruled that the lower court judge did not abuse its discretion in finding the inmate, Kwame Mathews, may remain detained under sentencing factors despite suffering from multiple sclerosis.
