Although the U.S. Supreme Court just spoke a few weeks ago, the Arthrex Appointments Clause litigation isn’t over yet.

At least two patent owners represented by prominent law firms told the U.S. Court of Appeals for the Federal Circuit on Wednesday that the remedy devised by the Supreme Court and implemented by the U.S. Patent and Trademark Office is constitutionally infirm.
