Bar complaints filed against former Trump DOJ official Jeffrey Bossert Clark over his role in seeking to overturn the 2020 election results are running into challenges with D.C. disciplinary counsel.

Lawyers at D.C.’s Office of Disciplinary Counsel, the independent office within the D.C. bar that investigates complaints against attorneys, have told two separate groups of attorneys that it will not docket their complaints against Clark. One of those notices, issued in April, cited insufficient evidence and a lack of personal knowledge. A second letter, sent last week, pointed to lack of personal knowledge. A decision to not docket a complaint—a procedural move that gives the complainant access to the targeted attorney’s response—does not necessarily mean the attorney is not under investigation.
