A panel of federal appellate judges grilled attorneys for former President Donald Trump, questioning whether they can even hear the former president’s bid to shield White House records about Jan. 6 from a congressional committee.

During an over three-hour-long argument Tuesday, Judges Robert Wilkins, Patricia Millett and Ketanji Brown Jackson had tough questions for Trump attorneys Jesse Binnall and Justin Clark. The judges in particular drilled down on how they should weigh Trump’s privilege claim against President Joe Biden, and how far—if at all—a court should wade into the dispute.
