Former Perkins Coie partner Michael Sussmann is asking a judge to toss out the false statements case brought against him by Special Counsel John Durham, claiming the indictment represents “extraordinary prosecutorial overreach.”

Sussmann’s defense team at Latham & Watkins filed a motion on Thursday to dismiss the indictment, arguing that the alleged false statement Sussmann made to the FBI in 2016 during a meeting about purported online links between the Trump Organization and Russia could not have influenced the bureau’s decision to investigate those allegations.
