The D.C. Circuit is the first federal appeals court to issue a ruling on whether COVID-19 tuition refund claims can go forward. Other appeals are pending in the Second, Fifth and Seventh circuits.

The U.S. Court of Appeals for the D.C. Circuit revived lawsuits that students filed against American University and George Washington University alleging the schools breached contracts by switching to online learning during the pandemic while charging in-person tuition.
Claims that the schools broke implied promises to offer in-person education and on-campus services in exchange for tuition and fees can go forward, the panel held.
