Texas’ many lawsuits against the Biden administration are evidence of one political party’s deliberate judge shopping that undermines public faith in the judiciary’s independence, charges an amicus brief in the U.S. Supreme Court.

The amicus brief, drafted by Jenner & Block partner Lindsay Harrison on behalf of University of Texas Law School’s Stephen Vladeck, was filed Wednesday in the emergency application, United States v. Texas. The Biden administration is asking the justices to block a district judge’s nationwide injunction against the immigration enforcement priorities in a September 2021 guidance issued by the Department of Homeland Security while its appeal goes forward.
