A panel of judges weighing whether to uphold sanctions against the so-called Kraken lawyers involved in failed postelection litigation in Michigan tried to zero in Thursday on who bears responsibility for what one judge called “provocative [and] bold” claims of voter fraud in the 2020 presidential race.

Judge Danny Julian Boggs, of the U.S. Court of Appeals for the Sixth Circuit, asked whether one of the sanctioned lawyers, Emily Newman, is responsible for the underlying frivolous lawsuit since she didn’t sign it. Newman said she only passed along an affidavit to the attorney leading the litigation team, former Trump lawyer Sidney Powell.
