What You Need to Know
- The First Circuit found on Nov. 23 that Evenflo consumers had alleged economic injuries due to alleged misstatements about the booster seats.
- The federal appeals court's decision revived the multidistrict litigation, which alleged that consumers overpaid for the booster seats given misstatements about their safety.
- Evenflo, in a petition for rehearing last month, argued that the First Circuit's decision created 'a split of authority' on the issue of Article III standing.
Lawsuits over Evenflo "Big Kid" booster seats will move forward after a federal appeals court concluded that consumers had standing to sue for economic injuries.
