A divided panel of the U.S. Court of Appeals for the D.C. Circuit fractured in a ruling reviving felony charges against three men who allegedly assaulted officers at the Jan. 6 Capitol riot.

Judges Florence Pan, a Biden appointee, and Justin Walker, a Trump appointee, said the defendants can be charged with corruptly obstructing an official proceeding under the “most natural reading of the statute,” even though the charge is typically applied in cases involving tampering with documents.
