The U.S. Court of Appeals for the 5th Circuit on Wednesday upheld a restriction on the president’s authority to remove members of the Consumer Product Safety Commission only for cause, applying a New Deal-era precedent that supports the structure of the CPSC and dozens of other federal agencies led by multi-member boards.

Rachel Rodman, a partner in Cadwalader’s fintech enforcement and litigation practice, called the ruling from the conservative appeals court a win for federal agencies broadly.
