The U.S. Supreme Court on Friday sided with an Arizona criminal defendant who claimed the state’s use of a “substitute expert” violated his constitutional right to confront a witness against him.
Although it did not go as far as proclaiming his Sixth Amendment rights violated, the court found petitioner Jason Smith had met a key condition for raising a potential confrontation clause argument.
