A federal judge on Monday dismissed the charges against former President Donald Trump over his alleged retention of classified documents at Mar-a-Lago, saying Special Counsel Jack Smith’s appointment was unlawful.

U.S. District Judge Aileen Cannon, whom Trump appointed in 2020, issued a bombshell ruling agreeing to throw out Smith’s criminal case against the former president. In a 93-page ruling, Cannon said Smith’s appointment as special counsel in 2022 by U.S. Attorney General Merrick Garland violated the Constitution’s appointments clause, which states that “Officers of the United States” must be appointed by the president and confirmed by the Senate.
