The U.S. Supreme Court should reconsider its rule that the constitutional right to a jury trial does not apply to “petty offenses” with a maximum penalty of less than six months in prison, two U.S. Court of Appeals for the Tenth Circuit judges said Tuesday.

Judges Timothy Tymkovich and Veronica Rossman issued their call in concurring with the Tenth Circuit’s decision upholding content creator and outdoor apparel brand owner David Lesh’s conviction at a bench trial for trespassing, in violation of National Forest Service regulations.
