A divided U.S. Court of Appeals for the Fourth Circuit has revived a PNC Bank customer's lawsuit accusing the financial services company of violating the Truth in Lending Act's prohibition on offsets.

Orrick, Herrington & Sutcliffe partner Fredrick Levin represented PNC and argued a home equity line of credit or HELOC is not a "credit card plan" under TILA, but the Fourth Circuit rejected that argument in a 2-1 majority opinion issued Aug. 14.
