The U.S. Court of Appeals for the Ninth Circuit said the First Amendment rights of an Oregon attorney were violated when the state bar published statements condemning remarks by former President Donald Trump and white nationalism.

The three-judge panel said the challenged statements in the Oregon State Bar’s monthly bulletin went beyond the organization’s primary role of regulating attorneys and purported to speak for all member lawyers, who pay mandatory dues. Therefore, officers of the bar may have infringed on the right to freedom of association of members who disagreed with the statements, the panel said.
