Pharmacy benefit manager Express Scripts' lawsuit claiming the Federal Trade Commission defamed the company and industry as greedy in a scathing report will go nowhere as the government is generally immune from defamation claims, a constitutional law professor said recently.
Express Scripts, a subsidiary of The Cigna Group, called for the FTC and its chair, Lina Khan, to retract the report in a defamation complaint filed last week in the U.S. District Court for the Eastern District of Missouri.
